Equipment Liability & Assumption of Risk

1. Care, custody and control

Once equipment is delivered or picked up, you have sole care, custody and control of all totes, lids, dollies, seals, tags and accessories (“the Equipment”). You are responsible for the Equipment’s condition, security and safe use for the entire rental period, including any time it is in the possession of your movers, family, friends, employees, or other third parties acting on your behalf.

Pack the Triad is not present during packing, loading, transport or unloading, and exercises no control over how the Equipment is used.

2. Condition at delivery

Equipment is inspected and delivered clean and in good working order. Please inspect it at delivery and report any damage, cracks, broken latches, missing lids or defective dolly wheels within 24 hours. Absent a report, the Equipment is presumed to have been received in good condition.

3. Proper use

You agree to use the Equipment only for its intended purpose — the temporary packing, transport and storage of ordinary household and office goods.

Rated capacity: 100 lbs per container, stacked no more than 5 high. Exceeding either limit voids any claim against Pack the Triad and makes you responsible for all resulting damage and injury.

You agree not to:

• Load any tote with contents weighing more than 100 lbs
• Stack totes more than 5 containers high, whether loaded or empty
• Overfill a tote such that the lid cannot fully close and latch
• Stand, sit, climb or place body weight on any tote, lid or dolly
• Stack totes in an unstable configuration, on uneven ground, or with heavier totes resting on lighter ones
• Load any dolly beyond its rated capacity, or stack totes on a dolly more than 5 high
• Drag, throw, drop, kick or slide totes across surfaces
• Use totes as a step stool, work surface, ladder, ramp or seat
• Store or transport hazardous, flammable, corrosive, explosive or perishable materials; liquids; firearms or ammunition; illegal items; live animals; or anything that may leak, stain, corrode or contaminate
• Cut, drill, paint, mark, adhere labels to, or otherwise modify the Equipment
• Expose the Equipment to open flame, extreme heat or prolonged direct sun
• Sublet, rent, sell, loan or transfer the Equipment to any other party
• Remove, deface or damage NFC tags, barcodes or identifying markings

4. Transport

Transport of loaded totes is performed entirely at your risk. You are responsible for properly securing all Equipment during transport, including adequate strapping, load distribution, and protection from shifting, tipping, weather and road debris.

Pack the Triad is not liable for damage to the Equipment, to your belongings, to any vehicle, or to any person or property arising from transport, loading or unloading — regardless of whether the transport is performed by you, a hired moving company, or any other third party.

5. Assumption of risk — lifting and physical injury

Moving is physically demanding, and a tote loaded to its 100 lb capacity is heavier than most people can safely lift alone. You understand and voluntarily accept that lifting, carrying, pushing, pulling, stacking or otherwise handling loaded totes and loaded dollies carries a risk of physical injury, including but not limited to back, neck, shoulder, knee and hand injuries; strains and sprains; hernias; crush injuries; slips, trips and falls; and injuries from tipping or falling stacks.

You assume all such risk for yourself and for any person you permit to handle the Equipment. You are solely responsible for deciding how much weight to place in each tote, for using safe lifting technique, and for obtaining adequate help.

You release Pack the Triad from any and all claims for personal injury, death or property damage arising from the handling, lifting, stacking, transport or use of the Equipment during the rental period, except to the extent such injury is caused by Pack the Triad’s own gross negligence or willful misconduct.

6. Damage, loss and replacement

You are responsible for the full replacement cost of any Equipment that is lost, stolen, destroyed or damaged beyond normal wear and tear during the rental period. Normal wear and tear means minor scuffs and surface scratches from ordinary use. It does not include:

• Cracked, split, warped or shattered totes or lids
• Broken or torn-off latches, hinges or handles
• Broken, seized or missing dolly wheels, casters or frames
• Damage from overloading, overfilling, dropping, stacking or improper transport
• Damage from heat, chemicals or hazardous contents
• Contamination, staining, mold, odor, pest infestation or biohazard requiring more than routine cleaning
• Missing lids, dollies, tags or seals

Charges for lost or damaged Equipment are assessed at return and billed to the payment method you have on file with us.

7. Contents are not insured

Pack the Triad provides containers only. Your belongings are not insured by Pack the Triad, and Pack the Triad is not liable for loss of, damage to, theft of, or deterioration of any item packed in the Equipment for any reason. We encourage you to check coverage under your homeowner’s, renter’s or mover’s insurance policy.

The optional contents-logging feature (NFC tags and photo logging) is provided as a convenience only. Entries are made by you, and Pack the Triad makes no representation as to their accuracy and accepts no liability based on them.

8. Indemnification

You agree to indemnify, defend and hold harmless Goodbye Boxes LLC, its owners, employees and contractors from any claim, demand, lawsuit, loss, liability, damage, cost or expense (including reasonable attorneys’ fees) arising from your use, misuse, storage or transport of the Equipment during the rental period, or from any breach of this agreement.

9. Limitation of liability

To the maximum extent permitted by North Carolina law, Pack the Triad’s total liability under this agreement, for any cause whatsoever, is limited to the amount you paid for the rental. Pack the Triad is not liable for indirect, incidental, consequential, special or punitive damages, including lost profits, moving delays, or costs of substitute containers.

10. Right of recovery

Pack the Triad may recover its Equipment at any time if it is being used in an unsafe or prohibited manner, if it is not returned by the agreed date, or if payment is not made. You grant permission to enter the delivery or pickup address for this purpose.

Acknowledgment

By checking the box at checkout and typing your name, you confirm that you have read, understood and agreed to this Equipment Liability & Assumption of Risk statement, that you are at least 18 years of age, and that you accept responsibility for anyone you allow to handle the Equipment.
